Online Ordering Terms
The terms and conditions set out below (Online Ordering Terms) apply to online orders for the supply of chocolate and confectionary products by Koko Black which are submitted via our online ordering facility at #kokoblack.com/order-online (Online Ordering Platform). The Online Ordering Platform is operated by Mobi2Go Pty Ltd
The use of the Online Ordering Platform is governed by these Online Ordering Terms and the Website General Terms at #kokoblack.com/legal (General Terms).
Without limiting the way in which you may become bound by these Online Ordering Terms, you will be deemed to have accepted and will be bound by these Online Ordering Terms by clicking a button on your computer screen, by submitting an Order or by accessing the Online Ordering Platform.
1 ACCESSING THE ONLINE ORDERING PLATFORM
1.1 You may browse the Online Ordering Platform and submit Orders via a user account (Account) by clicking on the registration link or when submitting an Order.
1.2 When you create an Account, you will provide your details (including your payment details) which we will store on your Account if you so nominate to store your payment details, to make it easier for you to submit Orders in the future.
1.3 To create an Account or submit an Order, you must be at least 18 years of age. By creating an Account or submitting an Order, you warrant that you are over the age of 18 year and that all other information given to us is true and correct.
2 PLACING ORDERS
2.1 To place an Order via the Online Ordering Platform, you will be required to specify:
(a) the chocolate and confectionary products that you want to order (Ordered Products);
(b) the address to which you want your order delivered (Designated Address);
(c) the delivery method you wish to use (Same Day/Next Day/Standard) (Delivery Method);
(d) your payment information; and
(e) any other details we require to finalise your Order.
2.2 Please ensure that you check all of the details you enter and correct any errors before submitting your Order, as we will begin processing your Order immediately. You won’t be able to cancel or vary your Order, except as allowed under clause 6.
2.3 We reserve the right to refuse any Order on any grounds.
3 SELECTING A DELIVERY METHOD (SAME DAY/NEXT DAY/STANDARD) / DELIVERY POLICY
3.1 When placing your Order, you will be asked to choose a Delivery Method, which is a desired day of your delivery from Koko Black.
3.2 All orders with delivery within Australia are shipped from Melbourne. We currently only deliver to addresses within Australia.
We reserve the right to hold your order in our temperature controlled facility if we have concerns about the weather causing damage to your order. We will endeavour to contact you if any changes to your scheduled dispatch date, or if your order has been held in our temperature controlled facility due to weather.
Same Day delivery orders are shipped via Fastway. We deliver same day Monday through Friday.
Same Day delivery is available to select ares in Melbourne only, as serviceable by our couriers. Orders must be placed before 12pm to allow for same day delivery.
The following Melbourne areas are eligible for Same Day delivery:
St Kilda Road
For Next Day and Standard Delivery we ship all orders with Australia Post.
We do not dispatch any orders via Australian Post on Friday to avoid increasing the time your order may be in transit and exposed to extremes in temperatures.
If you select the Next Day delivery option, we guanrantee next day delivery only to the postcodes specified at:
Order must be received by 12pm to qualify for Next Day delivery. Please check your postcode against the Australia Post guideline for expected delivery times,
In rural and regional areas of Australia, delivery times are in respect to delivery to the Post Office of the principal township in that area. Delivery to final destinations may take longer. If in doubt please check with your local post office.
3.3 Shipping Costs
Service Same Day – Ship from Melbourne - Charge $25
Service Next Day – Ship from Melbourne - Charge $15
Service Standard – Ship from Melbourne - Charge $15
The above postage and handling fees will automatically be applied to your online order and will be displayed in you total purchase amounf before payment is processed.
For special or large orders an additional shipping fee may apply over and above the standard shipping fees outlined. This will be assessed on a case by case basis according to volume and our team will contact you to discuss any additional fees where applicable.
To avoid additional charges we recommend any large or special orders be directed to email@example.com or call us on +61 3 9254 0720 for our team to assist. Orders over $500 may be eligible fo corporate pricing rates via our corporate sales team.
4.1 The prices published on the Online Ordering Platform will apply to the Ordered Products. All prices stated on the Online Ordering Platform are inclusive of GST.
4.2 Discounts or promotions cannot be applied to Orders submitted via the Online Ordering Platform. If you wish to take advantage of one of our discounts or promotions, please call one of our restaurants directly to place a telephone order.
4.3 We reserve the right to refuse an order or alter the agreed price if an incorrect price was given due to a software malfunction or interference with the Online Ordering Platform.
5.1 You must pay for the Products at the time of submitting your Order using an approved payment method.
5.2 The payment will be processed by us immediately and will be debited from your account in the timeframe set by your card or account provider.
5.3 If we are unable to authorise your payment via the selected payment method at check out, you will be alerted and your Order will not be processed.
5.4 We have engaged a third party payment provider to securely process credit and debit card payments and store payment details for Account holders. We will not store your credit or debit card information on our servers and will not have direct access to your payment information.
6 CHANGES & CANCELLATIONS BY YOU
6.1 Changes and Cancellations are subject to the following conditions:
(1) Orders which have been dispatched either via our Same Day courier service or via Australia Post cannot be cancelled.
(2) Orders which have not yet been prepared may be cancelled.
7 CHANGES & CANCELLATIONS BY US
7.1 If we are unable to fulfil your Order due to unforeseen circumstances, or if one of the Products is no longer available, we may contact you to cancel or vary your Order.
7.2 If a cancellation is required by us, we will contact you before your order is dispatched.
7.3 In such a case, we will determine whether it is appropriate to:
(1) replace the unavailable item with another item of a similar value;
(2) provide a partial refund of the price of the unavailable item;
(3) cancel the entire Order and provide a full refund;
(4) Dispatch the unavailable item at a later date at no additional delivery charge to you
7.4 Any approved refunds will be handled by our customer service team as set out in clause 9.
8 REFUND POLICY
8.1 Koko Black is committed to providing the best chocolate delivered in perfect condition every time. If you are unhappy with your experience for any reason, please let us know via firstname.lastname@example.org. Unless otherwise agreed, all products are sold on a no return for refund/credit basis, unless, subject to this clause:
(1) The products are received in a damaged state (that is not a result of environmental factors outside of our control, that have occurred after we have made delivery to your nominated address)
(2) Incorrect products are supplied to you
(3) The products are faulty
8.2 If an incorrect product is delivered to you (including any replacement products), or if the product differs from it’s description or is not of satisfactory quality, we will (at our discretion) deliver you a replacement product or refund you the price paid for the product in question.
8.3 Any decision to grant a refund will be at our discretion (subject to our legal obligations) but we will always endeavour to address any complaints to your satisfaction. Claims for credit/refund must be made with 48 hours of receipt of the products by you and must be emailed to email@example.com. We will process any approved refunds within 5 business days of approval.
8.4 In the event that we agree to a refund we may request you return the products to us. You will be notified of the appropriate procedure to comply with to return the products to us in good condition.
8.5 Koko Blaco accepts no responsibility for loss or damage occurring in transit on return to us.
9 NO RESALE OR THIRD PARTY PROVIDERS
9.1 The Online Ordering Platform is only open for Orders made on a direct to customer basis. Orders are only accepted on the condition that the person who places the Order must collect the Order in person for the purposes of private consumption. You must not resell or resupply any Products ordered via the Online Ordering Platform to a third party.
9.2 We may refuse, without any refund, any Order submitted via the Online Ordering Platform which we reasonably believe has been made by or through a third party delivery business.
10.1 We do our best to ensure that our product names, descriptions, prices, nutritional information and allergenic warnings are accurate, but accept no liability if any of the details published on the Online Ordering Platform are incorrect. If you have any doubt about the contents of any of our products, please contact the Creative Centre before you place your Order.
10.2 To the extent permitted by law, we exclude all liability for any loss or damage you sustain as a result of your use of the Online Ordering Platform or consuming Ordered Products, except to the extent caused by our wilful acts or omissions.
10.3 These Online Ordering Terms will apply to the extent permitted by law and none of these terms will be construed as excluding, qualifying or limiting your statutory rights or remedies.
11 YOUR INFORMATION
11.1 When you place an Order via the Online Ordering Platform you will be required to provide us with your personal information, including your full name, your email address, your mobile phone number and your payment information (Information).
We may vary these Online Ordering Terms at any time by publishing the revised terms on this website. The amendments will take effect from the next time you visit the Online Ordering Platform. If you do not agree with the revised terms, you must immediately stop using the Online Ordering Platform and delete your Account (if applicable).
13 GENERAL TERMS
The General Terms are incorporated by reference into these Online Ordering Terms. If there is any inconsistency between the two documents, these Online Ordering Terms prevail to the extent of the inconsistency, but only in respect of the Online Ordering Platform.
